The Tribunal has dismissed an urgent application for interim relief in which Apollo Studios (Pty) Ltd (“Apollo”) and Motomatix (Pty) Ltd (“Motomatix”) applied for an order to, among other things, interdict Audatex SA (Pty) Ltd (“Audatex”) from removing a software application called “PartSmart” from the Audatex platform.
 
The Tribunal’s reasons for its decision will be released in due course.
 
Audatex owns and operates an online software platform which facilitates electronic vehicle damage estimation and processing of automotive insurance claims.
 
PartSmart, owned by Apollo, is a software application that makes use of the Audatex platform. It automates and facilitates the procurement of replacement motor vehicle parts for vehicle repairs.
