| Summary | The Competition Tribunal ordered the separation of the complaint against South African Breweries (SAB) and its appointed distributors - Africa¡¦s Beer Wholesalers, Boland Beer Distributors, Ermelo Beer Wholesalers, Greytown Beer Distributors, Makhado Beer Wholesalers, Midlands Beer Distributors, Mkuze Beer Wholesalers, Southern Cape Beer Distributors, Stefquo, Vryheid Beer Distributors, Madadeni Beer Wholesalers, Westonario Beer Distributors and Thohoyandou Beer Distributors. The complaints under Sections 4 (1) (b) (ii), 5 (1), 5 (2) and 9(1) of the Competition Act will be heard and determined separately from the complaint under Section 8 of the Act. The hearing of the first separated complaint is set down for the period 2 to 27 August 2010. The sections 4, 5 and 9 allegations made by the Commission in its complaint referral are as follows: „X That the agreements concluded between SAB and the all respondents collectively, constitutes a concerted practice ( ie co-operative or co-ordinated conduct between firms in a horizontal relationship) which is prohibited in terms of section 4(1)(b)(ii) „X That SAB¡¦s wholesaler agreements and franchise agreements are agreements between parties in a vertical relationship which is prohibited by section 5(1) „X That SAB engaged in minimum resale price maintenance (price-fixing) in contravention of section 5 (2) „X „X That SAB through its agreements with all respondents concerned in this matter, engaged in price discrimination in contravention of section 9(1) The section 8 allegation is as follows: „X SAB engaged in practices which require or induce retail outlets not to deal with SAB¡¦s competitors in the market for the manufacture and sale of beer and the market for the distribution of liquor |
